Child Visa Options – If you are in Australia

Child visa (subclass 802)

This visa allows a child who is in Australia to stay in Australia.​

 

Requirements

This visa is for children who are:

  • in Australia
  • sponsored by an eligible parent.

 

Orphan Relative visa (subclass 837)

This visa allows the child to live permanently in Australia with their sponsoring relative.​

 

Requirements

A child might be able to get this visa if they are:

  • in Australia
  • an orphan, or their parents are unable to care for them
  • younger than 18 years of age
  • sponsored by their relative who is an Australian citizen, permanent resident or eligible New Zealand citizen

 

Dependent Child visa (subclass 445)

This temporary visa:

  • allows a child to travel to and from or stay in Australia until their parent’s permanent Partner visa is finalised
  • is required if the child is to be added to a permanent Partner visa application after a temporary Partner visa has been granted to their parent.

 

Requirements

A child might be able to get this visa if:

  • their parent holds a temporary Partner visa (subclass 309 or 820) or a Dependent Child visa (subclass 445)
  • they are sponsored by the same person who sponsored their parent
  • they are single
  • they are younger than 18 years of age, or one of the following:
  • financially dependent on their parent holding the temporary Partner visa, or
  • incapacitated for work due to the total or partial loss of bodily or mental functions.

 

Child Visa Options – If you are outside Australia

Child visa (subclass 101)

This visa allows a child who is outside Australia to come to Australia to live with their parents.​​​

 

Requirements

This visa is for a child who is:

  • applying outside Australia
  • sponsored by an eligible parent.

 

Adoption visa (subclass 102)

​​This visa allows a child who is adopted outside Australia to come to Australia to live with their adoptive parents.

 

Requirements

This visa is for a child who is:

  • applying outside Australia
  • younger than 18 years old
  • already adopted or in the process of being adopted
  • sponsored by an adoptive parent or prospective adoptive parent.

 

Orphan Relative visa (subclass 117)

​​​This visa allows a child to travel to and live permanently in Australia with their sponsoring relative.​

 

Requirements

This visa is for a child who is:

  • applying outside Australia
  • an orphan, or their parents are unable to care for them
  • younger than 18 years of age
  • sponsored by their relative who is an Australian citizen, permanent resident or eligible New Zealand citizen

 

Dependent Child visa (subclass 445)

This temporary visa:

  • allows a child to travel to and from or stay in Australia until their parent’s permanent Partner visa is finalised
  • is required if the child is to be added to a permanent Partner visa application after a temporary Partner visa has been granted to their parent.

  • their parent holds a temporary Partner visa (subclass 309 or 820) or a Dependent Child visa (subclass 445)
  • they are sponsored by the same person who sponsored their parent
  • they are single
  • they are younger than 18 years of age, or one of the following:

18a ‘Additional Applicant’ refers to an eligible member of the applicant’s family unit. ‘Additional Applicant’ does not refer to a sibling of the applicant, unless that sibling is a dependent of the applicant.

18b People who apply for a Partner visa and who hold a Dependent Child visa (subclass 445) are eligible for a nil visa application charge for the Partner visa.

18c Additional Applicant refers to an eligible member of the applicant’s family unit. ‘Additional Applicant’ does not refer to a sibling of the applicant, unless that sibling is a dependent of the applicant.

18d For an applicant whose parent has been granted a permanent visa, and who was included in:

  • the parent’s application for a Group 1.1 (migrant) visa under the Migration (1993) Regulations; or
  • the parent’s application for a business (joint venture) visa (code number 122) or a business (general) visa (code number 123) under the Migration (1989) Regulations; or
    for an applicant whose application is:
  • supported by a letter of support from a state or territory government welfare authority; or
  • combined, or sought to be combined, with an application made by that person.

18e People who apply for a Partner visa and who hold a Dependent Child visa (subclass 445) are eligible for a nil visa application charge for the Partner visa.
